The general objective of the research was to legally analyze the contamination of the tributaries of the San Antonio River due to illegal mining, Ecuador. The present research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A survey was also applied. It is concluded that the rights of nature are one of the main issues in Caluma because they are being violated by mining companies; not without mentioning that the day-to-day control of this problem corresponds to both the authorities and the GAD of the canton of Caluma, and the communities that live in the area, since it is a daily struggle with nature as the main object of conservation
