Preliminary apprehension and violation of the presumption of innocence

Abstract

The general objective of the research was to legally analyze prior apprehension and the violation of the presumption of innocence. The present research used the quantitative method, which produces descriptive data, originating from data collection. It was supported by a documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical method was also used. A survey was applied to 93 lawyers. It is concluded that the Constitution of the Republic offers society a coherent legal framework that allows the true exercise of the rights of a person such as human rights and in this case of persons facing a criminal proceeding in which their innocence is violated. For this purpose, it is necessary to apply the essence of international treaties and instruments that have configured the need to highlight the maximization of principles, including innocence.
