Abstract

The general objective of the research was to legally analyze the criminological factors of deviation presented in the public servant or superior hierarchical level official. The present research used the quantitative method which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. It has been possible to conclude that the theory of differential association is based on the fact that this is a sociological process in which the agent changes or deviates his behavior due to the influence of his circle of friends, relatives or neighborhood, and that this influence is due to the sophistication of the acts committed by the offenders.
