Infringement of the right to housing of the alleged gender violence offender

The general objective of the research was to legally analyze the violation of the right to housing of the alleged offender of gender violence. The research used the quantitative method which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review of refereed articles, laws and norms. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that domestic violence is a phenomenon that is deeply rooted in the Ecuadorian society, and this has been evidenced by surveys and measuring instruments presented by the State bodies. Criminal legislation in this context, represented by the COIP, is called upon to address cases in which the action has already materialized, that is, when the crime of violence against women or any member of the family group has already been perpetrated.
