Abstract

The general objective of the research was to legally analyze the formulation of charges and the principle of objectivity in cases of detention, Ambato-Ecuador. The method used in the research was based on the qualitative approach, supported by the documentary-bibliographic typology. The research technique applied was the interview, which was applied to three judges of the Provincial Court of Criminal Guarantees in the city of Ambato, to whom the interview guide was applied, it is clarified that the three public servants are duly certified as judges in accordance with the COFJ, of the Judicial Function. It is concluded that it is up to the judges to motivate according to their sound criticism to dictate the precautionary measure, so that the prosecutor proceeds to receive the version of the defendant and thereby consolidate its investigation, pursuing its purpose of clarifying the facts.
