Determination of the constitutional mutation of the legal institution of egalitarian marriage in Ecuador

Abstract

The general objective of the research was to legally analyze the determination of the constitutional mutation to the legal institution of egalitarian marriage in Ecuador. The research was developed from a qualitative approach, using several bibliographic sources in order to obtain real and updated information to achieve the objective set against the legal problem under analysis. The research technique applied was the interview to a group of key informants. It is concluded that the Constitutional Court has the power to interpret the constitutionality of the norms, decrees, among others, and the sentences and opinions issued by this Court are final and unappealable, it can be observed that currently they are overreaching and not only interpreting, on the contrary, they are legislating by means of these sentences as they are binding and of immediate application.
