Right to full reparation and the Organic Law on Jurisdictional Guarantees and Constitutional Oversight

The general objective of the research was to legally analyze the right to integral reparation and the Organic Law of Jurisdictional Guarantees and Constitutional Control. The methodology developed in this research was based on the quantitative approach, resorting to the documentary-bibliographic typology, which allowed establishing the analysis of the object of study, with the purpose of describing the topic addressed. In addition, the analytical-synthetic method was used jointly, by means of which a whole is broken down into parts, extracting qualities, components, relationships and more to later join the analyzed parts. The material approached consisted of norms, laws, graduate theses, scientific research and refereed works. It is concluded that constitutional law from the point of view of retribution or compensation in practice is usually misunderstood by the makers of justice, assuming that it is an obligation of the accused to restore the violated right to the victim.
