Abstract

The general objective of the research was to legally analyze the peaceful sit-in as an adequate mechanism to enforce the constitutional right, Latacunga, Ecuador. It was developed from the quantitative paradigm, also framed from a documentary-bibliographic design. For this purpose, Ecuadorian legislation and national doctrine were examined, making use of scientific articles and theses, as well as texts by authors who have previously explored this legal topic. Likewise, a survey of open questions was used in order to know the opinion of a total of 64 legal professionals registered in the forum of lawyers of the Judiciary Council of Latacunga. It is concluded that, as resistance is a right, the constitution itself cannot prohibit or diminish it, on the contrary, the necessary guarantees and mechanisms must be generated, so that the peaceful sit-in can become the appropriate mechanism to protest in a non-violent manner.
