Recognition of different types of families and their impact on homoparental adoption in Ecuador

ABSTRACT
The general objective of the research was to legally analyze the recognition of different types of families and its impact on homoparental adoption in Ecuador. The research was developed from the quantitative paradigm, and was also framed from a documentary-bibliographic design. For this purpose, Ecuadorian legislation and national and international doctrine were examined, making use of scientific articles and theses, texts of authors who have previously explored this legal topic, with the use of methodological instruments such as the documentary record. It can be concluded that limiting the possibility of adoption to same-sex couples is a constitutional and regulatory limitation. Therefore, applying the criteria of rationality and proportionality established by the Constitutional Court of Ecuador itself, it can be argued that Article 68 of the Constitution of Ecuador qualifies as a discriminatory provision, limiting the adoption rights of same-sex parents.
