The crisis of the prison system in Ecuador and its different legal factors

Abstract

The general objective of this research was to legally analyze the crisis of the penitentiary system in Ecuador and its different legal factors. The study, which sought to describe the crisis of the penitentiary system in Ecuador from the perspective of the legal professional, was based on the canons of the positivist approach and using quantitative methodologies.  Likewise, and as a strategy to respond to the research problem, a non-experimental design was assumed, since no variable was deliberately manipulated. In addition, it was supported by documentary-bibliographic analysis, whose sources are made up of laws, agreements, theses, among others. On the other hand, a questionnaire was applied to 100 legal professionals: judges, public defenders and/or prosecutors related to the penitentiary system in Ecuador. It is concluded that the crisis of the Ecuadorian penitentiary system is evident, where the violation of the rights of persons deprived of liberty is felt through overcrowding
