Abstract

The general objective of this research was to legally analyze discrimination in access to education: information technologies in pandemic. The approach taken by the researchers for the development of the methodology was based on the positivist paradigm with a quantitative approach, through the inquiry, collection and critical analysis of documents and bibliographic references, based on the methodical, rigorous and deep exploration of various documentary sources, articles, rules and laws, describing the findings. Showing a critical legal analysis related to the research topic. It is concluded that the existence of the shortcomings of the educational system was demonstrated. Through the legal and doctrinal foundation, it could be observed that the provisions announced by the Ministry of Education do not comply with the stipulations of Article 27 of the Constitution, which indicates that education is inclusive and that it will also promote equity, justice and solidarity.
