Abstract

The objective of this investigation was to legally analyze the right to defense in the anticipated testimonies within the Ecuadorian criminal practice. It was developed from the quantitative approach with a descriptive methodology with a non-experimental design, which was supported by the documentary-bibliographic analysis. By conducting a review of existing bibliographic material regarding the subject studied, the theoretical bases were reviewed and the existence of a serious violation of constitutional law in the criminal area was determined, becoming a challenge for legal professionals to defend their patrons in these conditions that even put at risk the rule of law and justice that is proclaimed in Ecuador. Concluding that it is necessary to urgently carry out a reform to the Comprehensive Organic Criminal Code that establishes that early testimonies should not be received without there being adequate procedural evidence with the notification of the suspect.
