Abstract

The general objective of the research was to legally analyze the right to resistance and its violation. It was based on a quantitative, documentary-bibliographic perspective. This in view of the fact that from the documentary review and the study of the social reality observed, reflective conclusions have been inferred by the researcher, of the problematic raised; from the analysis of theses, scientific articles and laws related to the subject of study. We also worked with a population involved in the problem that was composed of law professionals in free practice registered in the Bar Association of Cotopaxi, this population currently reaches 413 professionals. A sample of 200 lawyers were surveyed. It is concluded that, the generality established in Art. 98 of the Constitution of the Republic of Ecuador which states that individuals can exercise the right to resistance.
