Favorability principle in the preliminary investigation into culpable offences

Abstract

The general objective of the research was to legally analyze the principle of favorability in the preliminary investigation of culpable offences. This research used the quantitative method, which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. Together, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that, the benefit of the right of favorability in all types of crimes, with emphasis on those intentional offences that contemplate a penalty of less than five years in prison, so we recommend that the importance of this principle should continue to be applied not only in offences of a culpable nature, but also in intentional crimes and other crimes of great magnitude.
