Abstract

The general objective of the research was to legally analyze psychic influence as a direct instrument for perpetration-by-means in the crime of bribery. The present research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. Together, the inductive-deductive method was applied. The analytical-synthetic method was also used. In addition, a questionnaire was sent to 3 prosecutors, 3 judges of Criminal Guarantees and 3 academics of Pichincha. It is concluded that the psychic influence acts as a direct instrument for the perpetration-by-means in the crime of bribery, currently this influence given for reasons of power, hierarchy or abuse of power has generated the birth of this new crime that is not typified in an exhaustive manner in the Ecuadorian criminal law.
