The general objective of the research was to legally analyze the illegitimacy of judicial measures for noncompliance with alimony payments. The researchers approached the method from the positivist paradigm and the quantitative perspective, it was supported by a descriptive technique with a non-experimental documentary-bibliographic design. It was developed according to a documentary research design and recorded by other researchers in documentary sources. In addition, a survey was made to a population and sample conformed by different people of the city of Babahoyo, the same that are composed as follows: 50 lawyers in free practice. It is concluded that the right to food is a fundamental right of children and young people, but this right also affects the rights of others, such as parents. Freedom is not defended as a true fundamental right because it is controversial in the case of forced maintenance due to deprivation of liberty.
