The general objective was to legally analyze the abandonment of older adults and their forced withdrawal from their work activities, Ecuador. The research was developed from the quantitative perspective, due to the nature of the information collected, since it allows collecting, analyzing and obtaining numerical data on the variables obtained from the study. Likewise, descriptive research was necessary because of its demonstrative purpose, allowing to determine the incidences, activities and processes that exist in the different situations under study, which provides greater knowledge. It was supported by a documentary-bibliographic review, analyzing refereed articles, laws and theses. It is concluded that the application of the last paragraph of article 81 of the Public Service Law with respect to forced retirement, violates a series of rights belonging to the persons to whom the mentioned norm applies.
