Free mining, effective judicial protection, legal certainty and a healthy environment

The general objective of the research was to make a legal analysis of free mining exploitation, effective judicial protection, legal security and a healthy environment. It was based on a quantitative, documentary-bibliographic perspective. This in view of the fact that from the documentary review and the study of the social reality observed, the researchers have been able to infer reflective conclusions about the problems posed. Documentary analysis of laws, theses and their analysis were used as study techniques. In addition, a survey was applied to (100) lawyers in free professional practice, and to multicompetent judges of the Judicial Unit of Chimbo and Las Naves, Province of Bolivar. It is concluded that free mining exploitation violates the right to live in a healthy and ecologically balanced environment, given the environmental impacts generated by any activity of exploitation of non-renewable resources such as mining.
