Pardon as an effective measure to guarantee the right to health

The general objective of the research was to legally analyze the pardon as an effective measure to guarantee the right to health. The researchers proposed a quantitative approach as a method for the development of the research work, through exploration, collection and critical analysis by means of a documentary typology, supported by bibliographic design. In this regard, documentary sources at the theoretical level, theses, regulations, laws and refereed works related to the central aspects of the work were examined and analyzed. Twenty surveys were applied to lawyers in free practice in the canton of Santo Domingo. It is concluded that the pardon granted by Executive Decree 1086 safeguarded the right to health of 66 convicted persons who meet the requirements such as being sentenced seniors, living with children under three years of age, being sentenced with disabilities and with catastrophic and chronic diseases.
