Abstract

The objective is to analyze the legal consequences of the application of Executive Decree 813 issued on July 12, 2011, in order to determine the effects on the efficiency of the Administrative Management due to the dismissal of public servants, without the existence of an established procedure for their dismissal. Descriptive documentary research with bibliographic design. The figure of purchase of compulsory resignation with compensation, which terminates the functions of public servants from their jobs without there being a voluntary act of resignation from their jobs, implying a violation of labor rights and guarantees established in the Constitution and of the administrative processes framed in the Organic Law of the Public Service.
