Applicability of treaty law in expropriation judgments. Case: Salvador Chiriboga versus Ecuador

The objective is to analyze the applicability of conventional law in expropriation judgments. Case: Salvador Chiriboga versus Ecuador. Documentary type. It is necessary for the Ecuadorian State to take into account the sentences that have been issued against it by the Inter-American Court of Human Rights, in order to avoid committing the same violations to the rights for which the country has been sanctioned. Therefore, the administrative actions regarding expropriation must be based on the parameters established by the Inter-American Court of Human Rights in accordance with the American Convention on Human Rights, the need to perform an effective control of conventionality by the administrative authorities, who have the duty to enforce the provisions of the Convention, which is related to the analysis and compliance with the judgments issued against Ecuador, for its knowledge and application.
