Principle of unwaivability of labor rights under the Ecuadorian Constitution

Abstract

The general objective of the research was to legally analyze the principle of unwaivability of labor rights from the Ecuadorian constitutionality. The methodology developed was based on the quantitative approach, resorting to the documentary-bibliographic typology, which allows establishing the analysis of the object of study. The researcher understands and in turn covers topics that have been taken and studied by other people, which allows and facilitates the analysis of phenomena that cannot be reached directly. In this order of ideas, this work was oriented in the documentary design, since it allowed the collection of normative documents and laws. It is concluded that in spite of having the respective regulations, facts of violation of workers' rights have been committed both by the companies and by the State, since decrees have been originated that are in opposition to the Labor Law and its regulations.
