Abstract

The general objective of the research was to legally analyze the exclusion of evidence in the preparatory hearing and its incidence in the trial hearing. The present research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. Together, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that the exclusion of evidence in the preparatory hearing and its incidence in the trial hearing, through the demonstration with legal and doctrinal arguments, is not applied in such a way in such hearings and also that useless, inconductive and improper evidence is admitted in most opportunities, which has no legal relevance, let alone being able to prove a fact.
