Analysis of advance directives in voluntary and involuntary euthanasia in Ecuador and international comparison

Analysis of advance directives in voluntary and involuntary euthanasia in This article was written with the aim of analyzing advance directives in voluntary and involuntary euthanasia in Ecuador and comparing them internationally. The research was conducted using a qualitative approach, based on a review of the literature and documentary analysis. The results and findings confirm that there is a regulatory gap in Ecuador regarding advance directives in the context of euthanasia, even though Constitutional Court Ruling No. 67-23-IN/24 opened the door to voluntary active euthanasia under strict conditions. This gap creates legal uncertainty for patients and health professionals, as there are still no clear procedures or a legal framework to regulate its validity and application. In conclusion, the decriminalization of voluntary active euthanasia in Ecuador represents a jurisprudential milestone, but only an Advance Directives Law will consolidate this advance in medical law.
