Medical liability in emergency situations without the patient's express consent

This article was written with the aim of analyzing the conflict that arises between the patient's right to decide on their treatment and the physician's obligation to act in a timely manner to preserve life. The research was qualitative in nature, legal-dogmatic in type, based on the study of the Constitution, laws, and rulings of the Constitutional Court. The results show that case law accepts the emergency exception as valid provided that the action complies with lex artis and is properly documented. In conclusion, it is essential to strengthen institutional regulations and protocols to reduce legal uncertainty and guarantee protection for patients and physicians. It can be affirmed that medical civil liability in emergency situations without the patient's express consent is defined by a balance between the patient's autonomy and the physician's duty to preserve life.
