The general objective of the research was to analyze the lack of family protection in native communities and the rights of children and adolescents, Peru. The research method was based on the qualitative approach, using the collection and analysis of a documentary-bibliographic typology. The research technique applied was the interview; the tool or instrument is the interview guide, which is applied to 2 members of the multidisciplinary team, 4 prosecutors and 4 defense attorneys, generating an analytical-reflective process, contributing to the generation of the extension of the state of the art. The lack of family protection is the situation that occurs due to non-compliance or inadequate performance of the duties of care and protection of the family, therefore, the protective action of the State is guided by the principles of exceptional care and professionalism in governmental activities.
