Abstract

The objective is to analyze the affectation to the principle of proportionality in the preventive providences in the executive trials in Azogues - Ecuador. It is a descriptive documentary type with a non-bibliographic design, through the analytical review of documents and scientific articles related to the research topic, supported by a survey conducted by the author to know the perception of the actors involved in the executive trials in Azogues - Ecuador. The principles, all of them, are optimization mandates that have their most notorious impact on the legal and factual decisions that Judges and Judges make daily, therefore, the principle of proportionality is undoubtedly a weighting mandate with respect to the fundamental rights of the justiciable.
