Impact of the principle of the principle of lesivity in the prosecution of embezzlement as a crime against Public Administration

Abstract

The purpose of this study is to analyze the incidence of the principle of lese majeste in embezzlement as a crime against the Public Administration in a group of Latin American countries. We used the comparative law methodology and the statistical technique that allowed us to collect information. The results show that the crime of embezzlement is contemplated in the legislations of the countries of South America, however, its penalties are not uniform, leading to an increase in the corruption indexes, which results in the affectation of the State and the confidence of its inhabitants, who see their interests harmed by the deterioration of the national treasury. If this fraudulent crime against the Public Administration is not sanctioned by the State as rigorously as it should be, this leads to a promotion of corruption and leaves open the possibility of continuing to commit crimes.
