Abstract

The general objective of the research was to legally analyze the right to identity and the personal capacity to choose the order of surnames in Ecuador. It was developed under the qualitative approach, whose epistemological and methodological paradigm has made it possible to gather relevant information. In addition, in order to gather information on the legal perception of the population on the object of study, an interview was applied to free practicing law professionals with experience in constitutional matters in the Province of Tungurahua. Fifteen free practicing law professionals were considered. It is concluded that, both at a normative and doctrinal level, the patronymic form of identification not only allows individualizing the subjects, but also involves a legal relationship of legitimacy of the rights of persons before the protection of the State, establishing itself at a constitutional level as a set of attributes and characteristics, both static and dynamic.
