Constitutional change and the rigidity of the constitution

Abstract

The general objective of the research was to legally analyze the constitutional mutation and the rigidity of the constitution. It was developed from the quantitative paradigm, it was also framed from a documentary-bibliographic design, through the inquiry, collection and critical documentary and bibliographic referential analysis, based on the methodical, rigorous and deep exploration of various documentary sources such as scientific research, laws, articles, refereed works and theses. Describing the findings. On the other hand, the technique that will be used is the survey. The sample consisted of eight experts in constitutional matters. It is concluded that the constitutional mutation exercised through interpretation violates the due process of reform and does not comply with Article 84 of the Constitution, which prohibits that the reform or the acts of the public powers attempt against the rights recognized by the norm itself, under this consideration it is not attributable to the constitutional judges to perform arbitrary interpretation.
