Abstract

The general objective of this research was to legally analyze the presidential pardon for humanitarian reasons to avoid prison overcrowding in Ecuador. As a methodology, the qualitative approach was developed, using several bibliographic sources in order to obtain real and updated information to achieve the objective set out in relation to the legal problem. In addition, an interview was applied for the acquisition of information directly to two traffic agents of the Canton of Santo Domingo to know in real practice, what are the limitations and the procedure used when a scooter is involved in a traffic accident. We also interviewed the traffic prosecutor 2 of Santo Domingo de los Tsáchilas. It was concluded that it is necessary for Ecuadorian legislation to regulate the circulation of scooters, since the drivers of these vehicles interact directly with other traffic actors.
