Abstract

The objective of the research is to analyze the burden of proof in administrative sanctioning procedures. It is a descriptive documentary type with bibliographic design. It was said in the first lines of the article, that our society made an evolutionary leap regarding the rights of the citizen, being these more guaranteed and humanistic, so it is necessary that the instructor of the administrative sanctioning procedure assumes an activist role as a public servant, and to be clear that his report, formed with all the necessary evidence of the imputed responsibility, contains a precise pronouncement, providing the necessary inputs to the sanctioning public servant for the evaluation of the evidence practiced, and consequently unequivocally motivate his resolution, taking into account that such resolution will affect protected legal assets such as housing and work.
