Abstract

ABSTRACT

The general objective of this research was to legally analyze the transgression of the Non Bis In Idem principle in sanctions for illegal mining activity in Ecuador. It is subscribed from the quantitative paradigm, as well as from the support of documentary-bibliographic research. Due to the fact that the legal assumptions foreseen in the Ecuadorian legislation with respect to the research variable were reviewed, it was possible to determine the transgression of the non bis in idem principle, in which the Ecuadorian legal system incurs in the matter of illegal exploitation of minerals. It is concluded that the doctrine regarding the principle of non bis in idem is very clear, double punishment is prohibited, even when there is concurrence of a crime and an administrative infraction, however, in relation to the perpetration of the crime Illegal Exploitation of Minerals, the Ecuadorian legal system imposes penal, civil, administrative and even environmental sanctions, which constitutes an advance in the law.
