Genetic-biological information in heterologous fertilization as a fundamental human right

Abstract

The general objective of the research was to legally analyze the genetic-biological information in heterologous fertilization as a fundamental human right. The method of this research was developed from the quantitative approach, through the search, collection and critical documentary analysis, bibliographic reference. From a bibliographic design of documentary type, whose inquiry from the critical reflection, the method of analysis of the study phenomenon was constructed, considering laws, norms, agreements, international treaties, theses, which led to obtaining relevant information, the construction of the theoretical fabric and the generation of the respective conclusions. It is concluded that heterologous fertilization poses legal challenges in terms of filiation, since it is based on a medical technique and not on sexual reproduction. It is necessary to establish clear rules and laws to solve these legal gaps and guarantee the rights of children and their parents.
