Affecting the presumption of innocence and privacy in flagrante delicto apprehensions

Abstract

The general objective of the research was to legally analyze the affectation of the presumption of innocence and privacy in flagrancy apprehension.  The quantitative method was used, which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A survey was applied to 179 lawyers in free practice affiliated to the Council of the Judiciary in the Province of Chimborazo. It is concluded that, the procedure of apprehension in flagrancy undoubtedly has a design defect in its birth by the legislators, leaving an empty point to proceed, which makes us reach a conclusion that the apprehending subjects act erroneously violating fundamental constitutional rights and principles to the presumption of innocence and privacy enjoyed by the apprehended.
