Conditional Suspension of Sentence: lack of regulation and affectation of fundamental rights

Abstract

The objective of this study was to analyze the classification of the requirements to access the conditional suspension of the sentence in accordance with the provisions of Ecuadorian criminal law, considering the theoretical aspects related to national and foreign regulations in order to propose a reform in Ecuadorian criminal law for the proper application of the conditional suspension of the sentence. The basic methodology consisted of a research of descriptive scope, applying the bibliographic review as a technique. The synthetic analytical method was used in order to break down all the scientific material collected. The conditional suspension of the sentence is framed in the Comprehensive Organic Criminal Code, being a favorable option for imputable persons and its inapplicability based on the sentence in the abstract obviously violates not only the right to freedom, but also other fundamental principles such as favourability. , proportionality, non-discrimination.
