Our planet is being destroyed daily by the great indolent actions of human beings, we can see it in our daily life in the deforestation of forests, loss of diversity of flora and fauna, garbage in the city and partial destruction of the ozone layer. Ecuador is one of the nations with a great diversity in the Amazon region and since the Political Constitution of 1998, environmental protection has been regulated, enhanced in the Political Constitution of 2008, with the legal innovation of recognizing nature as a subject, in recognition of the native peoples through the sumak kwasay or also known as "good living". This research work is of a descriptive documentary type with bibliographic design and its objective is to indicate the recognition that our Organic Integral Penal Code makes to nature as a subject of rights and also within the constitutional scope as of 2008.
