The progressive use of force in Ecuador

The present research work on the unconstitutionality of the progressive use of force in Ecuador, aims to identify the parameters dictated by the Inter-American Court of Human Rights (CorteIDH); the Constitution of the Republic and the jurisprudence of the Constitutional Court, which allow to know the scope of the progressive use of force and understand that the non-compliance with these parameters, would lead to an unconstitutionality. The descriptive method with documentary analysis was used, using several updated scientific articles, reliable platforms and sentences issued by the Constitutional Court on the subject, by means of bibliographic references extracted from accredited databases. In this way, it was determined that the existing parameters in Ecuador on the use of force are insufficient, concluding that our legal system must provide the necessary means and resources for the proper use of such figure, through the rational and proportional use of force.
