Abstract

The general objective of the present research was to legally analyze the consent for the extraction of a bodily fluid in a criminal proceeding. The quantitative methodology was developed, which produces descriptive data, originating from the collection of data from a documentary-bibliographic source. Supported by a documentary-bibliographic study, which includes the national legislation applicable to the subject, books and relevant articles and documents of the Ecuadorian justice administration agencies such as the State Attorney General's Office in its role as director of the preprocedural and procedural criminal investigation, critically analyzing these sources and describing the findings found, allowing the development of the theoretical body. in relation to the subject of study. It is concluded that, in the Ecuadorian criminal process, the principle of evidentiary freedom governs, based on which the procedural subjects may request the judge to incorporate to the process any means of proof of guilt or innocence.
