The criminal offense of receiving and the principle of innocence in the right to defense

Abstract

The objective of this research was to legally analyze the criminal type of receiving and the principle of innocence in the right to defense. It was based on a quantitative, documentary-bibliographic perspective. This in view of the fact that from the documentary review and the study of the observed social reality, reflective conclusions of the researchers have been inferred. In this process, research works from peer-reviewed journals and graduate theses, laws and norms were analyzed, which allowed obtaining a theoretical body, which allowed the development of the subject matter and the elaboration of the respective results. It is concluded that the crime of receiving, is contrary to the constitutional norm since the person who should prove the guilt of the suspect is the one who is accusing, it is worth mentioning that the presumption of innocence will expire when lawful evidence is presented to determine guilt.
