Appeal and the right to defense against traffic violations

The objective of the study was to analyze the appeal and the right to defense against non-custodial traffic offenses. The methodology applied was based on a descriptive study with a non-experimental design, the analytical-synthetic method was used for the analysis and the technique applied was the case study and the bibliographic review, using scientific databases. With what is expressed in this legal norm, the guarantee of the impugnation consecrated in literal m, numeral 7 of article 76 of the Constitution is violated, as well as the norm of the American Convention of Human Rights, which refers to guarantees such as the right to appeal to a higher jurisdictional organ.
