The role of the victim as a procedural subject in Ecuadorian criminal law

Abstract

The objective of this paper is to analyze the role of the victim as a procedural subject in Ecuadorian criminal legislation, through the methodology of a judicial case study. It can be indicated that the role of the victim as a procedural subject is currently only as a mere statement, because there is no regulation capable of demanding that a victim plays or assumes this role in a responsible manner, but only to the extent that it satisfies many of the times their personal objectives, therefore, when these rights are made effective, they are not always linked to the search for truth and justice, which would be the objectives of any society; With the proposed reform, that is to say, establishing the obligation to receive testimony in advance for the arraignment hearing in general and in all types of criminal offenses could ensure effective results in the investigations.
