Violation of the fundamental rights of the investigated and sentenced person

The objective is to analyze the violation of the fundamental rights of the investigated through the judicial past, as well as to investigate the existing regulations in order to avoid penal and social discrimination in the Ecuadorian reality. A descriptive documentary study was carried out by means of the bibliographic review technique. The violation is measured through violations of the rights of people, in this case of people who are going through a judicial process, who served a sentence or who after the relevant investigations were declared innocent, however, in the Ecuadorian state in the legal system there is no structure of laws that collaborate with these cases, it is simply established that it is its obligation to respect, protect, guarantee and promote rights, for this reason it was found convenient the enactment of public policies that support these obligations.
