The article is of a documentary review type, which aimed to analyze the conditional suspension of the sentence in the face of the existence of a new fiscal Instruction in Ecuador. Criminal policy can be a study factor that requires a more in-depth analysis if that is the case, but for the purposes of this project, only the spirit of the law will be taken as a basic factor, which states that the feeling of security is perceived and at the same time time to avoid the overcrowding of prisons for trifling crimes, or not so reprehensible. It is therefore to this relationship between the presumption of innocence and the conditional suspension of the sentence where the source of debates for the application of the same is created, which refers to extending debates that lie in the most prominent nature of the presumption of innocence, confronted with the punitive apparatus of the State.
