Abstract

The general objective of the research was to legally analyze the theory of punishment and its relationship with victimology. The research method was based on a qualitative approach, using the collection and analysis of a documentary-bibliographic typology, which allowed us to organize an analysis of the object of study. For this analysis, refereed works and texts, among others, were considered. An analytical-reflexive process was generated, contributing to the generation of the extension of the state of the art. Three legal professionals were interviewed. It is concluded that victimology and the theory of punishment go hand in hand because the sanctions should be established based on the seriousness of the damage caused to the victim, respecting the rights of both parties, although society supports the person who received the damage more.
